These Terms govern your use of Alongside Events, operated by Roman Kucheryavyy and Anna Kucheryava, doing business as Alongside Coffee, in Auburn, Washington, USA (“Alongside,” “we,” “us”). By creating an operator account, customizing an event as a couple, or placing an order as a guest, you agree to these Terms.
Operators are the paying customers who run events. You are the data controller for your guests and couples. You must have the rights and permissions necessary for any content, guest data, allergen information, and branding you put into the platform, and you are responsible for compliance with the laws that apply to your business and events.
Couples / event hosts customize their bar through a private link. By submitting content, you confirm you have the right to use it and that it will appear on the operator’s surfaces and the couple keepsake recap. Guests order through a QR microsite. By placing an order you agree to Section 7 (guest content) and, if you opt in, Section 6 (SMS).
You’re responsible for activity under your account. Keep credentials secure and don’t share them outside your business. You represent that you are 18+ and have authority to bind the business you register.
First event — free. Every operator’s first event is free; no card required.
Per event — $30. Each additional event costs $30, charged via Stripe when you upgrade the event to the paid tier. Runs the full single-event experience: QR ordering + POS, ready-SMS, the recap keepsake + photo wall, couple customization with AI signature drinks, barista mode, and label printing.
Studio — $79/month. For operators running their cart as a business: unlimited events (no per-event charge), your own branding on the recap, corporate & private event types, concierge mode + staff link, VIP priority codes, and the full back office — client CRM, quotes, invoices, e-sign contracts, the pricing calculator, and revenue & operations analytics. Cancel anytime; future months aren’t charged after cancellation.
To keep the “first event free” promise fair, we deduplicate operator accounts at signup against email, phone, and normalized business name; an account matching an existing operator who already used their free event will have its first event treated as paid. We don’t disclose your contact info to other operators in this check. We don’t take a percentage of your drink sales; drink prices are between you and your couples.
Payments are processed by Stripe; by purchasing you also agree to Stripe’s terms. You can request a refund of any paid event from the event’s Controls tab — most are processed within one business day, after which the event’s tier reverts to free. You can manage or cancel a Studio subscription anytime from the billing portal (linked from your dashboard). Studio subscriptions are non-refundable for past months, but you may cancel anytime and won’t be billed for future months. Taxes, if any, are your responsibility.
Don’t: scrape or attempt to access another operator’s data; upload content that infringes anyone’s rights or privacy; harass, defraud, or deceive; attempt to break, overload, or probe the service; send unsolicited or marketing SMS through the platform; or use the platform to facilitate the sale of regulated or unlawful substances. We may suspend accounts that violate this section.
The guest SMS feature is opt-in by the guest through the QR ordering flow only, via an unchecked-by-default consent box. Up to two transactional texts may be sent per order (order received + order ready), and the same consent enrolls the guest in the operator’s loyalty & rewards program, which may send occasional perks, offers, and giveaway-prize messages. Every message begins with the operator’s business name and ends with “Reply STOP to unsubscribe, HELP for help.” STOP and HELP are honored automatically; message and data rates may apply on the guest’s carrier. Walk-up orders never collect a phone number.
Our messaging runs over a verified toll-free number (Twilio Toll-Free Verification) — not unsolicited marketing. As an operator you agree: (a) not to send unsolicited SMS, or messages outside the program a guest consented to; (b) to keep your business name accurate, since it identifies the sender to recipients; and (c) at events using QR ordering with SMS, to make a brief at-cart notice available (e.g. near the QR) that texts will be sent if a guest provides a number and ticks consent. You are responsible for TCPA and related compliance for the events you run; we provide the consent UI, the STOP/HELP handling, and the carrier-of-record relationship via Twilio as tooling, not as legal advice.
Guests upload photos and notes from their own phones; photos remain private until the operator approves them, and the operator is the final moderation gate. The upload flow requires the guest to affirm consent of everyone pictured, with guardian permission for any minors. By ordering, a guest agrees that their first name and any guest-book note may appear on the couple’s token-gated recap alongside aggregate stats, and that a review they write may appear as anonymous social proof on the operator’s public cart page. We never publish a named “who ordered what” list. Operators agree to honor a guest’s or couple’s request to remove a specific name, note, or photo. Note that a token-gated page is reachable by anyone with its link; operators and couples are responsible for their moderation and sharing decisions.
Allergen information on the menu is supplied by the operator. Alongside is the platform that displays the menu — not the supplier of any drink. You are responsible for the accuracy of allergen tags and for verbally confirming allergens with guests at the cart. The guest flow shows a “this drink contains” summary plus a disclaimer that allergen info is operator-supplied and may not be exhaustive.
The guest menu may also display approximate calorie and macronutrient figures. These are automated estimates from general reference values, labeled “approx,” and are not a verified nutrition panel, not medical or dietary advice, and not a substitute for professional guidance. Actual values vary with recipe and preparation; allergen tags remain the authoritative safety information.
You agree to indemnify and hold us harmless for any claim arising from your supplied allergen or nutrition information being incomplete or inaccurate, or from the food/beverage you serve.
Several features use Anthropic’s Claude: the paid “AI signature drinks” feature proposes drink names and descriptions from a couple’s questionnaire; the AI barista chats with guests to help them choose a drink and adds it to their cart; and an optional morning-after debrief email summarizes an event’s own numbers for the operator. Each runs a content-safety check, and the barista is instructed to work only from the operator’s real menu and to make no health or medical claims.
AI systems can still produce unexpected, incomplete, or incorrect results. AI suggestions are for convenience only and are not a substitute for the judgment of the operator’s staff — especially for allergens, dietary needs, and pricing, which a guest should always confirm at the cart. The operator and couple keep final editorial control (the keep/discard step for signature drinks; the live menu and staff for the barista), and we are not responsible for AI-generated content that is relied upon, kept, or published.
You retain ownership of everything you upload (logos, cart and menu photos, copy). You grant us a limited, worldwide, royalty-free license to host, process, and display that content solely to operate the service for you (render microsites, signage, recaps, and labels). You represent that you have the rights to everything you upload and won’t upload trademarks, logos, or images you don’t own or aren’t licensed to use. We own the platform itself, our software, and our branding; nothing here transfers our IP to you.
The paid tier supports label printing when a compatible printer is configured. Hardware setup is your responsibility; printer outages don’t block order intake — a failed print surfaces as a reprint prompt.
We work to keep the service running, and live-event support is our top priority, but the service is provided without an uptime guarantee and may be interrupted. Keep a paper-menu fallback for critical moments. The service is not warranted to be uninterrupted or error-free.
You may delete an event anytime from its Controls tab (permanently removing its orders, photos, reviews, and messages) and cancel your account anytime. We may suspend or terminate accounts for abuse or breach; absent an emergency we’ll give notice and a reasonable window to export your data.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). NEITHER PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.
You agree to indemnify, defend, and hold us harmless from any third-party claim, damage, loss, or expense (including reasonable legal fees) arising from (a) your use of the service; (b) your menu, allergen, or nutrition information or the food/drinks you serve; (c) your collection of guest consent and your SMS practices; (d) your moderation of guest content; (e) AI-generated content you chose to keep; (f) content you uploaded without the right to do so; or (g) your breach of these Terms.
Any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by JAMS or AAA in Washington State under their consumer arbitration rules. You and we waive the right to a jury trial and to participate in any class, consolidated, or representative action. If this waiver is found unenforceable, the arbitration clause is severable and the dispute proceeds in the state or federal courts of King County, Washington. Either party may bring qualifying claims in small-claims court without first arbitrating.
30-day opt-out: you may opt out of this arbitration agreement by emailing support within 30 days of first accepting these Terms; opting out doesn’t affect the rest of the Terms.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles.
We may update these Terms; material changes are announced in-product, and continued use after a material change means you accept the update.
Some optional features connect to services we don’t operate. The espresso-machine integration lets an operator link a compatible La Marzocco Home account to read shot times and machine status. This integration is unofficial and not affiliated with, endorsed by, or supported by La Marzocco. La Marzocco does not publish a public API; the integration works with their consumer app’s service and may change, break, or stop working at any time without notice. “La Marzocco,” “Linea Mini,” and related names are trademarks of their respective owner, used here only to identify compatible hardware (nominative use).
When you connect a machine, we use your La Marzocco login once to sign in, then store only a revocable, encrypted access token — never your password — and communicate with La Marzocco’s servers to read shot data. You can disconnect anytime, and changing your La Marzocco password immediately cuts the link. Your use of La Marzocco’s own service remains governed by La Marzocco’s terms and privacy policy. WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY THIRD-PARTY SERVICE, FOR ITS AVAILABILITY OR ACCURACY, OR FOR ANY LOSS ARISING FROM ITS USE, CHANGE, OR DISCONTINUATION.
Features we label “Beta,” “optional,” or similar — currently including the La Marzocco espresso-machine integration and its derived readouts — are provided for convenience, are not part of the core paid Service, and may be changed, limited, or removed at any time. They are made available “AS IS” and “AS AVAILABLE,” without any warranty, uptime commitment, or support obligation, and are excluded from any service commitment. TO THE FULLEST EXTENT PERMITTED BY LAW, WE HAVE NO LIABILITY WHATSOEVER ARISING FROM BETA OR OPTIONAL FEATURES, AND YOUR USE OF THEM IS AT YOUR OWN RISK. Nothing in this section expands our liability beyond the cap in Section 14.
When a machine is connected, the platform may show shot counts, extraction times, a “shot consistency” score, machine status, and similar figures on the barista screen, the operator analytics, the debrief email, and the couple keepsake recap. These are best-effort estimates derived from a third-party cloud service on a polling interval — they are not a certified measurement, not a scientific or commercial instrument reading, and can be delayed, incomplete, or inaccurate. Labels like “machine-verified” mean the number was read from the connected machine’s data feed, not that it has been independently certified. They are provided for interest and insight only, and you should not rely on them for any regulated, contractual, or commercial purpose.
